1. Termination date

The Landlord and the Tenant agree to end the lease for the premises above on ____________________ (the Termination Date), before its original end date.

2. Moving out

The Tenant will move out and return possession of the premises, with every key, by the end of the Termination Date, leaving them clean and in the condition received apart from normal wear and tear.

3. Rent and termination fee

Rent remains due on the usual dates up to the Termination Date. The Tenant will pay an early termination fee of $____________________ on or before the Termination Date.

4. Security deposit

The security deposit, less any lawful deductions itemized in writing, will be returned within the time the law requires after possession is returned.

5. Release

Once the Tenant has moved out and paid what this agreement and the lease make due up to the Termination Date, neither party has any further obligation under the lease, except for damage beyond normal wear and tear and the return of the security deposit.

What is a lease termination letter?

A written notice from the landlord that a lease ends on a given date: early by agreement, at the end of its term, or a month-to-month tenancy ended with the notice the state requires. It sets out the move-out, the rent until then and the return of the deposit.

What should a lease termination letter to tenant say?

The date, every tenant’s name, the property, the date the tenancy ends, that rent is due until then, how the move-out and the deposit work, and your signature. Keep it short and factual; in most places no reason is required.

What is the difference between a notice of lease termination and a lease termination agreement?

A notice is one-sided: the landlord tells the tenant the tenancy ends, which works when the law or the lease lets you end it. An agreement is signed by both sides, which is how a fixed-term lease ends early when neither side has a right to end it alone.

How much notice does a month to month lease termination letter need?

37 of 50 states ask for 30 days; the range runs from 3 days in Connecticut to 90 days in Washington. Choose the state in the form and the letter states the period and the statute, and warns you if the end date comes too soon.

When do I use an early lease termination letter?

When you and the tenant have agreed to end a fixed-term lease before its end date, for example a job move with an early termination fee. A landlord cannot end a fixed-term lease early alone unless the lease or the law allows it; for the agreement itself, use the lease termination agreement both of you sign.

How should I deliver a lease termination letter?

What if the tenant does not move out after the letter?

The tenant becomes a holdover, and the next step is the eviction process your state sets out. Do not change the locks or remove belongings yourself: that is unlawful almost everywhere in the US.
