Rhode Island eviction process: the landlord’s steps from notice to removal
The eviction process in Rhode Island starts with the 5-day demand notice: 5 calendar days for unpaid rent (R.I. Gen. Laws §§ 34-18-35, 34-18-56(a)). Then the landlord files in the district court, where the case is called eviction action; the court hears it, and after judgment a court officer carries out the removal.

Step by step
The eviction process Rhode Island landlords follow, step by step
Notice and court names are given as they read on Rhode Island’s own forms, and timing details are quoted from the statute.
- 1
Step 1
Serve the notice
Unpaid rent: the 5-day demand notice, 5 calendar days (R.I. Gen. Laws §§ 34-18-35, 34-18-56(a)).
Paying everything owed inside the period ends the case, by statute.
Another breach of the lease: the notice of non-compliance, 21 calendar days (R.I. Gen. Laws § 34-18-36).
No reason, month to month: 30 days’ notice (R.I. Gen. Laws § 34-18-37).
What the statute adds, in English
Sent once rent is 15 days in arrears, in the form of § 34-18-56(a); suit may be filed no earlier than the 6th day after mailing. Paying in full before suit cures, and paying arrears and costs at the hearing also cures unless the tenant had a demand notice in the prior six months.
- 2
Step 2
File the eviction in court
File in the district court, where the case is called eviction action (R.I. Gen. Laws §§ 34-18-35, 34-18-36, 34-18-52; 5-day appeal and execution timing per the R.I. District Court landlord-tenant FAQ).
- 3
Step 3
Go to the hearing
The statute sets no timetable for the hearing that we could confirm; the court schedules it.
- 4
Step 4
Judgment and appeal
If the court rules for you, the tenant has 5 days to appeal.
- 5
Step 5
Removal by a court officer
An officer of the court carries out the removal, on the court’s order.
In the statute, in English
execution may issue from the 6th day after judgment if no appeal is filed

Only some steps have a number in the statute, so no honest total exists: after filing, the court sets the pace.
Can you change the locks yourself?
No. Rhode Island bans self-help eviction (R.I. Gen. Laws § 34-18-34), so only the court process can remove a tenant.
A tenant unlawfully excluded, or whose heat, water or electricity is willfully cut, may recover possession or end the agreement and recover up to three months' rent or three times actual damages.
The court process is the safe course in every state.

Where Dardaris comes in
Most evictions start as one late payment. Dardaris sees it on day one.
It notices the missed rent the day it is due, sends the tenant a reminder, and if nothing comes, drafts the Rhode Island notice with its 5 calendar days. You read it and sign; nothing goes out without you.
