The notice a landlord serves before filing for unpaid rent.

The month or period the rent was for.

In Kansas, the 3-day notice to pay rent gives the tenant 3 days. Paying the full amount inside the period stops the eviction, by statute.

K.S.A. 58-2564(b): The three days are three consecutive 24-hour periods from delivery or posting, plus two days if the notice is mailed. Paying within that time stops the termination.

Every field is optional; a blank one prints as a line to write on. The notice is in English, as it is served in the US.

The rules

What a valid Kansas eviction notice must say

  1. 1Its name: 3-day notice to pay rent, the words Kansas law uses.
  2. 2The tenants’ names, every other occupant, and the address of the premises.
  3. 3The rent owed, the period it was for and the date it was due.
  4. 4The period: 3 days, counted from the day after it is delivered.
  5. 5That paying in full inside the period stops the eviction.
  6. 6The statute it is given under: K.S.A. 58-2564(b).
  7. 7Your signature and the date, and a proof of service filled in once it is delivered.

What the statute says about unpaid rent

The three days are three consecutive 24-hour periods from delivery or posting, plus two days if the notice is mailed. Paying within that time stops the termination. (K.S.A. 58-2564(b))

What the statute says about a lease violation

The lease ends no sooner than 30 days after receipt unless the tenant remedies the breach within 14 days. A repeat of the same or a similar breach after that allows a 30-day notice with no chance to cure. (K.S.A. 58-2564(a))

Delivery

How to serve an eviction notice in Kansas

The statute names these ways to deliver it (K.S.A. 58-2564(b); K.S.A. 61-3803). Fill in the proof of service on the notice the day you do it.

  • leaving a written copy with the tenant
  • leaving a copy with a person over 12 residing on the premises
  • posting in a conspicuous place on the premises if no such person is found
  • mailing to the tenant at the premises (two extra days allowed)
