Louisiana eviction notice: a free template with the statute cited

In Louisiana, a landlord owed rent serves a 5-day notice to vacate: the tenant has 5 business days, not counting Saturdays, Sundays and legal holidays to move out before you can file, and the statute gives no right to stop it by paying (La. C.C.P. art. 4701).

Fill in the eviction notice template Louisiana landlords serve

The notice a landlord serves before filing for unpaid rent.

The month or period the rent was for.

In Louisiana, the 5-day notice to vacate gives the tenant 5 business days, not counting Saturdays, Sundays and legal holidays. Saturdays and Sundays are skipped in that count; each holiday inside it moves the end one day later. The statute does not give the tenant a right to stop the eviction by paying.

La. C.C.P. art. 4701: The notice must give at least five days from delivery, and Louisiana courts tell landlords not to count weekends or holidays. A lease may waive the notice in writing, in which case the landlord can file at once, and no statute lets the tenant stop the eviction by paying.

Every field is optional; a blank one prints as a line to write on. The notice is in English, as it is served in the US.

What the statute says about unpaid rent

The notice must give at least five days from delivery, and Louisiana courts tell landlords not to count weekends or holidays. A lease may waive the notice in writing, in which case the landlord can file at once, and no statute lets the tenant stop the eviction by paying. (La. C.C.P. art. 4701)

What the statute says about a lease violation

The same five-day notice applies whatever the reason the right of occupancy ended, and the Code gives no right to cure a breach. The same written lease waiver applies. (La. C.C.P. art. 4701)

Use a method the statute names, and fill in the proof of service the same day.

The questions that follow.

What goes in a {abbr} eviction notice template?

The name Louisiana law gives it (5-day notice to vacate), the tenants and the premises, the rent owed or the breach, the days the tenant has and how they are counted, the statute, your signature and a proof of service. The generator above puts each of them in.

If the tenant is still there, you file a rule to show cause (eviction) in the justice of the peace, city or parish court, or district court. Our guide to the Louisiana eviction process walks through each step.

Can I change the locks instead?

No. Louisiana bans lockouts and utility shut-offs (La. C.C.P. art. 4731(C)); only a court can order a tenant out.
