Free eviction notice Colorado landlords can use

Colorado eviction notice: a free template with the statute cited

In Colorado, a landlord owed rent serves a 10-day demand for compliance or possession: the tenant has 10 days to pay in full or move out, and paying in time stops the eviction (C.R.S. § 13-40-104(1)(d); C.R.S. § 38-12-1303).

Fill in the eviction notice template Colorado landlords serve

The notice a landlord serves before filing for unpaid rent.

The month or period the rent was for.

In Colorado, the 10-day demand for compliance or possession gives the tenant 10 days. Paying the full amount inside the period stops the eviction, by statute.

C.R.S. § 13-40-104(1)(d); C.R.S. § 38-12-1303: The demand is in the alternative, pay or deliver possession; 5 days for an exempt residential agreement (a single-family home whose landlord owns five or fewer) and 3 days for employer-provided housing. Since April 2024 a landlord also needs one of the listed causes to evict.

Every field is optional; a blank one prints as a line to write on. The notice is in English, as it is served in the US.

The rules

What a valid Colorado eviction notice must say

  1. 1Its name: 10-day demand for compliance or possession, the words Colorado law uses.
  2. 2The tenants’ names, every other occupant, and the address of the premises.
  3. 3The rent owed, the period it was for and the date it was due.
  4. 4The period: 10 days, counted from the day after it is delivered.
  5. 5That paying in full inside the period stops the eviction.
  6. 6The statute it is given under: C.R.S. § 13-40-104(1)(d); C.R.S. § 38-12-1303.
  7. 7Your signature and the date, and a proof of service filled in once it is delivered.

What the statute says about unpaid rent

The demand is in the alternative, pay or deliver possession; 5 days for an exempt residential agreement (a single-family home whose landlord owns five or fewer) and 3 days for employer-provided housing. Since April 2024 a landlord also needs one of the listed causes to evict. (C.R.S. § 13-40-104(1)(d); C.R.S. § 38-12-1303)

What the statute says about a lease violation

For a material breach the tenant may comply within ten days; a repeat of the same breach allows a 10-day notice to terminate with no cure, and a substantial violation (such as a violent or drug felony on the premises) allows a 3-day notice to quit. (C.R.S. § 13-40-104(1)(e), (1)(e.5), § 13-40-107.5)
