Acceptable use policy

What the product may and may not be pointed at: who you may contact through it, what you may put in, what the automation may be told to do, and what it must never be used to decide.

This is the full text. A summary of the parts that matter most is on the acceptable use policy summary, and every section there opens the section it summarises. The summary is a reading aid. This document is the policy.

1. What this is

1.1 Dardaris is a product of Techroun LLC, Shams Business Center, Sharjah Media City Free Zone, Al Messaned, Sharjah, trade licence number 2543150.01 issued by Sharjah Media City, tax registration number 105325244900001.

1.2 This is the Acceptable Use Policy the terms of service name and incorporate. It is part of your agreement with us.

1.3 It exists because this product does things to other people. It writes to your tenants, reads a mailbox you connect, runs a model over documents you upload, books contractors, and chases money on a schedule. The limits below are about that, not about generic misuse of a website.

1.4 Where this policy and the terms disagree, the terms win. This policy adds to them and does not cut them down.

1.5 It applies to you, to everyone you invite to your account, and to anything done with your credentials.

1.6 It uses the words the terms define. Service, Workflow, Output, Customer Data and Tenant mean here what they mean there.

2. Who you may contact through it

2.1 Use it to reach people you have a relationship with and a lawful basis to contact: your tenants and applicants, their guarantors, your contractors and suppliers, and your own team.

2.2 Do not use it to send marketing to a person who has not consented to it, to send anything to a list you bought or scraped, or to contact someone who has told you to stop. Where you do send marketing, the consent is yours to hold.

2.3 Consent and the rules on when a person may be contacted are yours. The terms say so, and this policy does not move that line.

2.4 A connected mailbox is read to file and answer what arrives about your portfolio. Do not connect a mailbox you are not entitled to read, and do not connect a shared or personal mailbox whose other correspondence you have no right to have processed.

2.5 Nothing sent through the product may impersonate somebody else, or claim to come from us.

3. What you may put in

3.1 Put in the records your portfolio is actually made of. You warrant in the terms that you collected them lawfully and may instruct the processing we describe.

3.2 Put in the special categories of data, or criminal offence data, only where the feature you are using expressly supports them and you hold the basis and the conditions the law requires. That is what the terms allow, and the data processing agreement says what happens when a document turns out to contain them anyway.

3.3 Do not upload material you have no right to hold: another landlord's portfolio, a file taken from a former employer, a document obtained without permission.

3.4 Do not upload malware, or a file whose purpose is to attack the product, another customer, or the person who opens it.

3.5 Storage is for running your portfolio. Do not use it as a general file host or a backup target for material the product has nothing to do with.

4. What the automation may be told to do

4.1 A Workflow runs without you watching it, so what you point it at is your decision and your responsibility. The terms set that out.

4.2 Do not configure an automation to do something you would not be allowed to do by hand. Sending on a schedule does not make an unlawful message lawful.

4.3 Do not configure one to defeat a limit the product applies to protect somebody: a spend cap, an approval step, or a step that waits for you on purpose. Quiet hours are the exception the terms already allow you to override, and the responsibility for overriding them is yours.

4.4 Guardrails may only tighten. You must not try to defeat a tier that has been raised, or configure around it.

4.5 Do not run an automation at a volume that is really a test of our infrastructure rather than the management of a portfolio.

5. What it must never be used to decide

5.1 The product produces generated text, and generated text can be wrong. It is a draft and a suggestion, never a finding.

5.2 Do not use it as the sole or determining basis for deciding whether to let a property to somebody, whether to renew, or on what terms. That is what the terms prohibit. In the United States the Output may not be used as a factor in such a decision at all: the terms say we are not a consumer reporting agency and the Output is not a consumer report.

5.3 Do not use it to screen people by a protected characteristic, or to produce a ranking that does so indirectly.

5.4 Do not use it to decide anything about a person that the law requires a human to decide, or to avoid giving a person a decision they are entitled to.

5.5 Do not present its output to a tenant, an authority or a court as a professional opinion, a legal conclusion or a survey.

6. Money

6.1 An arrears ladder writes to a person about a debt. Use it only for a debt that is actually owed, and stop it when the debt is disputed or settled.

6.2 Do not use the product to threaten, to harass, to contact somebody at a time or a frequency the law does not allow, or to imply a consequence you have no right to impose.

6.3 Do not use it to charge a fee, an interest rate or a penalty the lease and the law do not permit.

6.4 Bank and payment details in the product are for reconciling your own rent. Do not use them for anything else.

7. Contractors and a property

7.1 Dispatching a contractor sends a person to somebody's home. Send one you are entitled to send, to a property you manage, for work that needs doing.

7.2 Access codes and key information are the most sensitive thing in the product. Do not share them beyond the person who needs them for the job, and do not keep one that should have been changed. The terms say more.

7.3 The product is not an emergency service. Do not rely on it to summon help where life, safety or a building is at risk.

8. The service itself

8.1 Do not try to reach another customer's data, or test whether you can, except against your own account.

8.2 Do not probe, scan or attack the Service. If you find a vulnerability, tell us at support@dardaris.com and give us a reasonable time to fix it before telling anybody else.

8.3 Do not reverse engineer the Service, or use it to build a competing product.

8.4 Do not scrape it, automate it outside its documented interfaces, or route another company's customers through your account.

8.5 Do not evade a rate limit, a quota or a suspension.

8.6 Do not resell access, or share one account across businesses that should each have their own.

9. Content that is never acceptable

9.1 Nothing unlawful, and nothing that infringes somebody else's rights.

9.2 Nothing that sexualises a child, and nothing that depicts or promotes serious violence.

9.3 Nothing designed to defraud, including a document made to look like one we would produce.

9.4 Nothing that harasses or targets a person, whether a tenant, a contractor or one of us.

10. What happens if this is broken

10.1 We may limit, throttle or suspend the Service, immediately where it is necessary, on the grounds the terms set out.

10.2 We would rather tell you first. Where the risk allows it, we will say what the problem is and give you a chance to put it right.

10.3 A serious or repeated breach can end the agreement, and you indemnify us for a breach of this policy under the terms.

10.4 We report what the law requires us to report, and nothing here stops us doing so.

10.5 If you think we have this wrong, write to support@dardaris.com. A suspension is not a judgement about you and we will look again.

11. Language

11.1 This document is written in English, and the English text is the operative version to the extent the law permits. We publish translations of it so that it can be read in the language you work in. A translation is an approximation offered as a reading aid, it is not a second original, nobody is bound by its wording, and where it differs from the English text the English text is the one that applies.
